You are coming to Nice for a few months. An internship, a training course, a transfer, an assignment. The *bail mobilité*, a French furnished lease of 1 to 10 months, was created for this case.

This guide explains how it works, who can sign it and what to prepare. It draws on the law and on the example of a 77.51 m² furnished apartment on Bellet hill, west of Nice.

01What is a bail mobilité?

The bail mobilité is a rental contract for a furnished home, signed for 1 to 10 months. It was created by the loi ELAN du 23 novembre 2018. It is governed by articles 25-12 et suivants de la loi n° 89-462 du 6 juillet 1989.

It covers a furnished home, as defined by article 25-4 of the same law. It is meant for a person who comes to Nice for a specific reason and for a limited time.

02How long does a bail mobilité last?

It lasts 1 to 10 months. The length is set at signing.

It can be neither renewed nor extended automatically. At the end of the lease, the contract ends. If you stay longer, a new contract is needed, under a different regime.

The length can be changed once by amendment, up to 10 months in total.

At Les Piafs des Collines, the minimum length is 1 month.

03Who can rent with a bail mobilité in Nice?

On the date the lease takes effect, the tenant must show one of these reasons:

  • professional training;
  • higher education;
  • an apprenticeship contract;
  • an internship;
  • voluntary work under a service civique;
  • a professional transfer;
  • a temporary assignment as part of their professional activity.

A medical intern, a doctor in training, a manager sent on assignment, a transferred employee or an intern all fit this list.

04What documents are needed before signing a bail mobilité?

Proof of the reason is requested before signing. Depending on your case:

  • an internship agreement;
  • a certificate of enrolment or of posting;
  • an assignment contract or a transfer letter;
  • an assignment order.

Add the usual documents of a rental application: an ID and the guarantee you choose.

The contract states the reason for mobility. It also states that the landlord cannot require a security deposit.

05Is a security deposit required for a bail mobilité?

No. The landlord cannot ask for a security deposit in a bail mobilité. The law forbids it (article 25-17).

So you do not pay any blocked sum when you move in.

06Is the Visale guarantee possible?

Visale is a free guarantee from Action Logement. It is only granted if the rent, charges included, stays under a ceiling set by Action Logement.

At this apartment's rent level, Visale is not available. The guarantee takes the form of a guarantee from your employer or a personal guarantee.

07Can the employer rent the home in its own name?

Yes. When a company, a relocation agency, an insurer or a production pays for the home, the lease is in the name of that organisation.

It is then a lease governed by the code civil, separate from the bail mobilité. The loi du 6 juillet 1989 protects a person's main residence, and a company has none. At Les Piafs des Collines, this lease works as follows:

  • from 3 months;
  • invoice in the organisation's name;
  • no proof of reason required.

This is the route provided for a company housing an employee. The purchasing department receives a single invoice, in its name.

08What does the rent of a bail mobilité include?

The rent is set in the contract under articles 17 et 18 de la loi du 6 juillet 1989. Charges are paid as a fixed amount set in the contract, with no later adjustment (article 25-18). At Les Piafs des Collines, the monthly price includes:

  • charges and energy: electricity, water, heating and air conditioning;
  • fibre internet;
  • a private parking space within the grounds;
  • bed linen and towels provided on arrival;
  • end-of-stay cleaning.

The tenant receives no energy bill. This furnished residential rental, with no hotel-type services, is exempt from VAT (article 261 D, 4° du code général des impôts). The amount shown is the amount paid, with no VAT added and none recoverable. Home insurance remains the tenant's responsibility.

10How do you end a bail mobilité?

The tenant can leave the home before the end of the lease. They give one month's notice. They send it by registered letter with acknowledgement of receipt, by a deed from a commissaire de justice (bailiff) or by hand delivery against a receipt.

The landlord, for its part, does not give notice. The lease ends on the date set in the contract, unless a judge terminates it because the tenant has failed in their obligations.

13How do you request availability?

Note your move-in date and the length. Say who pays the rent: you, your employer, an agency, an insurer or a production. Prepare proof of your reason.

With these three items, you receive an answer on availability for the move-in date you asked for.
